But there was a post here a few days ago that RB had a brake bias valve that would apply more brake to the rear inner wheel, which was banned. That fits perfectly to Max’ statements.

The FIA denied that any team was using such a device, it’s likely a team asked if such a thing would be legal ahead of fitting it and the FIA decided to make it preemptively and explicitly illegal in the rules.

If another team finds out RB is using it then asks the FIA if they are legal the FIA could have no knowledge that RB had fitted one.

Likely they would have suggested RB have it fitted at the same time, why miss an opportunity to fuck them up?

It wouldn’t fuck them up though, using it before it was outlawed is perfectly legal. This kind of thing has happened before where team A notices team B is using something funky. Team A asks the FIA to clarify the rules so they can be certain it’s legal before copying. The FIA then says it’s illegal and neither team gets to use it from that point on.

Well it would if it costs them performance and it had to be took off in a hurry, as it takes time to do a work around that doesn’t cost performance if it’s even possible without major work. Any rapid change like that is hard to deal with.
