FRESNO, Calif. (KSEE/KGPE) – An ICE agent who was found sleeping on a lawn in Fresno was shot in the stomach after police say he refused to move and attacked the 72-year-old homeowner, causing the homeowner to shoot him in response.

Police say 32-year-old David Gonzalez of Texas also appeared intoxicated during the incident.

Investigators established that one of the two victims in the incident returned home to find the ICE agent, David Gonzalez, sleeping on her front lawn. She told her 72-year-old father, who also lived there, causing her father to go outside to send Gonzalez on his way.

Officers say Gonzalez refused to move and assaulted the 72-year-old victim, forcing him to the ground. The 72-year-old victim’s daughter then intervened, causing him to attack her as well. The 72-year-old victim then produced a gun and shot the ICE agent, David Gonzalez, in the stomach.

Shortly afterwards, the 72-year-old’s daughter’s boyfriend, an off-duty police officer, arrived and handcuffed the ICE agent, David Gonzalez. He was later taken to the hospital and is expected to be booked into Fresno County Jail after he has been treated.

I feel like if one of the victims here wasn’t dating a cop this would’ve gone the other way and they’d both be dead or in jail now, but hey, seems like things more or less worked out like they should have here at least

incredibly based and I hope it inspires more defense like it. I’m sure the reason the family gets off is their police connection, but considering ICE loves doing blatantly illegal home invasion shit like this, states with “Stand your ground” type laws should be sending these bastards home in body bags. No court is gonna find someone guilty of firing on a masked maniac trying to kidnap your daughter, or son, or husband, or wife.
