Olivia and Brooke Huss, 10 and 12 respectively, were found not guilty on charges of criminal mischief after Springdale police charged them with breaking a swing at a borough park while playing with friends.

In court documents, copies of which were supplied to TribLive by the girls’ mother, Katie Huss, police accused the girls of breaking a chain on a swing set with “malicious intent.”

District Judge Michael Girardi on Aug. 20 found the girls not guilty, but not before they had to appear for two hearings on the charges.

Even with the acquittal, they might not be out of the woods yet. Katie Huss said borough officials have vowed to file a civil complaint in the matter to recover the cost of repairing the swing.

    The way the swing was broken makes it even worse.

    The girls were seated on either end of a seesaw swing as their friends spun them around, twisting the swing’s chain and then letting it spin out.

    We did this when I was a kid decades ago and there certainly wasn’t any “malicious intent.”

    Dayoub was hired as a full-time officer in Springdale in 2013. Before that, a Public Source investigation found he faced a handful of civil lawsuits while he was an officer in Washington County’s Smith Township. He was accused of using excessive force by multiple plaintiffs, was charged with criminal assault after an encounter with a teenage McDonald’s employee, and was fired from the township after the chief accused him of falsifying a report.

    What a guy.
